What Employers Need to Know
Virginia has released an updated Job Safety and Health Protection notice from the Department of Labor and Industry (DOLI). The updated poster reflects increased Virginia Occupational Safety and Health (VOSH) penalty amounts that took effect September 3, 2026, and must be displayed in a prominent place where employees normally report to work.
What Changed
- Maximum penalty for each serious and other than serious violation increased from $16,287 to $16,652
- Maximum penalty for failure to correct a violation within the proposed time period increased from $16,287 to $16,652 per day
- Maximum penalty for each willful or repeated violation increased from $162,849 to $166,500
These penalty amounts apply to private sector employers. Public sector employers remain subject to the penalty provisions of 16VAC 25-60-260. The revised notice is dated August 2026, features updated DOLI branding, and is also available in Spanish.
Key Details Included in the Notice
The notice informs employers and employees of their rights and responsibilities under the VOSH law, including:
- Employer duty to provide a workplace free from recognized hazards and to comply with VOSH standards
- Employee right to have a representative accompany the VOSH inspector during an inspection
- Citation posting requirements at or near the place of the alleged violation
- Accident reporting: fatalities within 8 hours; in patient hospitalizations, amputations, or loss of an eye within 24 hours
- Contact information for DOLI headquarters and regional VOSH offices across Virginia

Employees may file a complaint with the nearest VOSH office if they believe unsafe or unhealthy conditions exist, and VOSH will withhold their names on request. Employers may not retaliate against anyone for raising a safety or health concern or reporting a work related injury or illness, and employees who believe they were retaliated against may file a complaint with the Commissioner within 60 days.
