What Employers Need to Know
The Illinois Department of Human Rights (IDHR) has released an updated Job Discrimination and Sexual Harassment notice, dated September 2026. The updated poster now lists religion, along with pregnancy and disability, as a basis for reasonable accommodations in the workplace. The notice applies to all Illinois employers covered by the Illinois Human Rights Act and must be displayed where employees can readily see it.
What Changed
- The Reasonable Accommodations section changed from pregnancy and disability to pregnancy, religion, and disability
- The accommodations section now describes changes for recovery from childbirth and pregnancy related conditions such as lactation and menopause
- The opening section now states that employers may not treat people differently or harass them based on a protected class, and lists pregnancy as including related conditions like menopause
- The three step Report Discrimination section replaced with a website, email, phone numbers, and a QR code for filing a charge
- The Sexual Harassment and Discrimination Helpline is now listed as 877-236-7706, available Monday through Friday, 10 AM to 6 PM
Illinois law already required employers to reasonably accommodate an employee's religious beliefs and practices, so the update brings the poster in line with existing requirements. Employers must replace the 2022 version with the updated notice to remain compliant.
Key Details Included in the Notice
The one page IDHR notice explains employee rights under the Illinois Human Rights Act, including:
- The right to be free from unlawful discrimination and sexual harassment in all employer actions, including hiring, promotion, discipline, and discharge
- Protection based on race, sex, disability, sexual orientation, pregnancy, and any other protected class named in the Act
- The right to request reasonable changes to a job when needed for a disability, religion, pregnancy, recovery from childbirth, or pregnancy related conditions
- How to file a charge of discrimination with IDHR online, by email, or by phone at its Chicago (312-814-6200) or Springfield (217-785-5100) offices, or by TTY at 866-740-3953
- Contact information for the Sexual Harassment and Discrimination Helpline
Employers may not treat employees differently because they reported discrimination, took part in an investigation, or helped others exercise their right to complain about discrimination. Employers must make the poster available and display it where employees can readily see it.
