What Employers Need to Know

Florida's minimum wage increases to $15.00 per hour on September 30, 2026. This is the final scheduled $1.00 increase under the constitutional amendment Florida voters approved on November 3, 2020. Because the rate printed on the Florida Minimum Wage Notice is changing, employers must display the updated notice to stay compliant.

What Changed

  • Florida minimum wage changed from $14.00 to $15.00 per hour
  • Direct cash wage for tipped employees changed from $10.98 to $11.98 per hour
  • The maximum tip credit remains $3.02 per hour, based on the 2003 FLSA tip credit

This completes the step increases that began in 2021. Starting September 30, 2027, Florida's minimum wage will no longer rise by a set $1.00 each year. Instead, it will be adjusted annually for inflation, which means Florida employers should expect a new minimum wage notice every year going forward.

Key Details Included in the Notice

The Florida Minimum Wage Notice explains the following:

  • Employers must pay the state minimum wage for all hours worked in Florida.
  • Definitions of employer, employee, and wage follow the federal Fair Labor Standards Act (FLSA).
  • Employers of eligible tipped employees may take a tip credit of up to $3.02 per hour, but must pay a direct wage of at least $11.98 per hour.
  • Section 448.109, Florida Statutes, requires the notice to be posted in a conspicuous and accessible place in each establishment where covered employees work.
  • The notice will be available in English, Spanish, and Creole.
  • Employers must also post the federal minimum wage notice required under the FLSA.

Employees who are not paid the Florida minimum wage may bring a civil action against the employer or any person violating the law. The Attorney General, or another official designated by the Florida Legislature, may also bring a civil action to enforce the state minimum wage.
