The Equal Employment Opportunity Commission (EEOC) has indicated that its “Know Your Rights: Workplace Discrimination is Illegal” posting may be revised following recent executive orders issued by the president.

The agency first noted this potential update on its posting website in February 2025, but no official release date has been announced. The delay may be related to operational challenges within the commission.

Why the Delay?

The EEOC currently lacks a quorum. Normally, the commission has five members, and at least three are needed to make certain decisions. Currently, only two commissioners are serving.

Without a quorum, the EEOC can continue to investigate discrimination claims, but it cannot vote on rules, policies, or guidance. This limitation may be contributing to the delay in revising the poster.


What’s Changing?

While the EEOC has not released the new notice, it is expected to reflect two recent executive orders:

  • Executive Order 11246: References to this order, which affects federal contractors, may be removed.
  • Gender identity and sex: Language regarding gender identity may be updated.

Current Recommendations for Employers

Employers with 15 or more employees and federal contractors should continue displaying the June 27, 2023 version of the poster. They should be prepared to update once the new version is officially released.
