What Employers need to know
New Jersey has released an updated New Jersey Family Leave Act (NJFLA) notice. The updated poster reflects amendments that took effect July 17, 2026 and significantly expand who is covered under the law.
What Changed
- Employer coverage threshold reduced from 30 employees to 15 employees worldwide
- Minimum length of employment reduced from 12 months to 3 months
- Minimum hours worked in the preceding 12 months reduced from 1,000 hours to 250 hours
These changes bring many smaller employers under NJFLA coverage for the first time and make far more employees eligible for job protected leave.
Key Details Included in the Notice
Eligible employees can generally take up to 12 weeks of job protected leave in a 24 month period to:
- Care for or bond with a child within 1 year of birth, adoption, or foster placement
- Care for a family member, or the equivalent of family, with a serious health condition
- Care for a family member isolated or quarantined due to suspected exposure to a communicable disease during a state of emergency
- Provide required care for a child if their school or place of care is closed due to a public health emergency
Leave may be taken as a consecutive block or on an intermittent or reduced schedule. Employees are entitled to return to their same position, and employers may not retaliate against anyone for taking or attempting to take NJFLA leave.
