Overview

The California Civil Rights Department (CRD) has released an updated Survivors of Violence and Family Members of Victims Right to Leave and Accommodations notice (CRD E20N-ENG), effective July 2025. This notice outlines important protections and time-off entitlements for survivors of violence and their family members. Employers are required to provide this notice:

  • Annually
  • At the time of hire
  • Upon employee request
  • Any time an employee discloses they are a survivor or the family member of a survivor of violence
  • This is not required in the standard State or Federal posters.

What Changed

The July 2025 version consolidates and expands employee rights under California law related to:

  • Paid and unpaid leave entitlements
  • Safety-related workplace accommodations
  • Confidentiality protections
  • Anti-retaliation rights
  • Additional legal protections under related state programs

The notice also clarifies eligibility based on employer size (25 employees) and the relationship of the employee to the victim.

Key Details Included in the Notice

Time Off Work
Employees have the right to take time off for:

  • Jury duty or court appearances
  • Seeking legal remedies (e.g., restraining orders)
  • Safety planning or relocation
  • Attending court proceedings related to the violence
  • Providing or receiving medical, legal, or mental health services
  • Caring for a child or dependent affected by violence

Leave entitlements vary depending on the situation:

  • Up to 12 weeks if the employee is a survivor or a family member of a deceased victim
  • Up to 10 days (or 5 days for relocation purposes) if the employee is a family member of a living victim

Workplace Accommodations
Employees can request reasonable changes to their work environment to enhance safety. Employers must respond in good faith and may request a certification related to the accommodation.

Confidentiality
Employers are required to keep any information about the employee’s situation confidential unless required by law or necessary for safety. Notice must be given before disclosure.

Additional Leave Rights
Employees may also be eligible for:

  • State Disability Insurance (SDI)
  • Paid Family Leave (PFL)
  • Leave under the California Family Rights Act (CFRA)
  • Bereavement leave
  • Time off to attend court under Labor Code sections 230.2 and 230.5
