What Employers Need to Know

Hawaii has released an updated Wage and Hour Laws Notice to Employees. The updated poster reflects an amendment to the Hawaii Family Leave Law that took effect August 27, 2026 and adds a qualifying military exigency as a covered reason for leave.

What Changed

  • Qualifying reasons for family leave expanded from the birth or adoption of a child and caring for a family member with a serious health condition to also include a qualifying military exigency
  • Minimum wage section updated to remove the expired $14.00 rate from January 1, 2024, now listing only the $16.00 and $18.00 rates
  • Notice redesigned with updated Department of Labor and Industrial Relations branding

Employees with a family member in the military now have another circumstance under which they can take job protected leave, and covered employers must display the updated notice to remain compliant.

Key Details Included in the Notice

The notice outlines employee rights under Hawaii's wage and hour laws, including:

  • A minimum wage of at least $16.00 per hour beginning January 1, 2026, and at least $18.00 per hour beginning January 1, 2028
  • Overtime pay of at least 1.5 times the regular rate for all hours worked over 40 in a workweek
  • Payment of wages at least twice monthly on regular paydays designated in advance
  • Up to 4 weeks of unpaid, job protected family leave for employees with at least 6 consecutive months of service at employers with 100 or more employees
  • Protection against wrongful wage deductions, such as fines, cash shortages, and breakage costs
  • The right to refuse a lie detector test

Employees have the right to file a complaint for unpaid wages with the Wage Standards Division within one year from the time the wages became due. Employees may also file a complaint if they are suspended, discharged, or discriminated against solely because of a work injury that is compensable under the Workers' Compensation Law.
