GENETIC INFORMATION NONDISCRIMINATION ACT


President Bush signed the Genetic Information Nondiscrimination Act of 2008 (GINA) on May 21, 2008. GINA has two Titles of interest to the public. Title I amends the use of genetic information in health insurance and affects portions of the Employee Retirement Income Security Act (ERISA), the Public Health Service Act, and the Internal Revenue Code. While Title II prohibits the use of genetic information in employment, prohibits intentional acquisition of the same regarding the applicants and employees, and imposes strict confidentiality requirements.


GINA requires the Equal Employment Opportunity Commission (EEOC) to issue regulations to implement Title II of the Act. This prompted the EEOC to publish a Notice of Proposed Rulemaking last March 2, 2009. Public comment period for the proposal ended last May 1, 2009 and is scheduled to be effective on November 21, 2009. Title II affects both private and public employers with more than 15 employees and since GINA is relevant to the EEOC, as a result a new poster has been released and is included in all our State and Federal combination posters as well as our Federal posters.
