Family Medical Leave Act

As you are all aware, there have been recent changes in the Family Medical Leave Act of 1993. President Bush signed into law HR 4986, National Defense Authorization Act FY 2008, in which section 585 amended the existing FMLA, hence the supplementary Military Family Leave Notice.

 

To summarize the amendments, the changes include enabling eligible employees to take up to 12 weeks of leave due to any “qualifying exigency” developing out of any covered family member’s active military duty and, allowing those eligible employees to take up to 26 weeks of leave in a single 12-month period to take care of a covered servicemember.

 

The Military Family Leave Notice is for only companies who employ 50 or more employees in each working day during each of the 20 calendar workweeks in the preceding or current year. Covered employers also include all public agencies (i.e. city, state, municipal, village governments, public authorities, schools districts, etc.), and for both public and private elementary and secondary schools without regard to the number of employees in either cases.

 

Last February 11, 2008, the Department of Labor released the proposed rule changes to the current FMLA that covers important facets of the Act that are advantageous for employers. A comment period until April 11, 2008 is in effect for any public reactions, comments, etc. on the proposed changes. It still remains to be seen whether or not these changes will be implemented. The intended revisions are considered to be the most extensive since the Act’s implementation in the 90’s. Listed below are some of the topics that the DOL included in their proposal.

To ensure complete compliance, the government released a supplementary notice for covered employers to be posted alongside the 1993 FMLA to reflect the current amendments.
